Generally, individuals will be interested in filing either a Chapter 7 (Liquidation) or Chapter 13 (Reorganization). You get to keep exempt property, and debts are either discharged (made legally unenforceable) in a Chapter 7, or may be partially paid in a Chapter 13. A Chapter 7 takes about 90 days, and a Chapter 13 takes 3-5 years. The Court filing fees are $299.00 for a Chapter 7 and $274.00 for a Chapter 13. Two classes are required - (a) a consumer credit counseling class before filing, and (b) a financial management/budgeting class while your bankruptcy is pending. The cost is approximately $100.00. Attorney's fees are generally $2,500.00 for a Chapter 7 and $3,200.00 for a Chapter 13. More complex cases may be more expensive.
