Probate is the process for admitting the Last Will and Testament of a person who has died into the official court records. Its purpose is to legally determine the persons who are supposed to inherit from the decedent (the person who died). The Executor (male) or Executrix (female) gets Letters Testamentary from the Court, or Letters of Administration. The Executor (or Executrix) winds up the Estate by paying bills, distributing property to the heirs, cleaning out and selling a house, or other property, transferring car titles, etc. Letters Testamentary are equivalent to an After-Death Power of Attorney. A Will is a relatively low cost way of distributing property at death. Other choices, such as a Living Trust, are appropriate in some circumstances, but can be expensive.
